Dispute Resolution

If we are unable to resolve the dispute informally within sixty (60) days, you agree to resolve the dispute through binding arbitration rather than in court.

Any arbitration will be conducted under the rules of the American Arbitration Association and will take place in Fresno, California. The arbitrator's decision will be final and binding, and judgment on the arbitral award may be entered in any court having jurisdiction.

You waive any right to a jury trial and agree that any dispute will be resolved on an individual basis and not as part of a class action or representative proceeding.

Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or to prevent irreparable harm.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Fresno County, California, and you hereby consent to the personal jurisdiction and venue of such courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and Lineretailer regarding the use of the website and supersede all prior agreements and understandings.
